These are the times when research has to be thorough, pleadings have to be impeccable and deadlines have to be met. But there are also occasions where we have to think outside the box. Where an approach needs to be tried that hasn’t been seen before – or where something different is needed to grab the attention of the person we’re speaking, pleading or consulting with. These are the creative tasks that we enjoy the most. Whether it’s Batman in the middle of a blockbuster film or your new favourite band playing a sold out gig at a top venue, creative thinking is what gets them into those positions. But no matter how well your letter is worded or how succinct your pleading might be, the approach – the creativity – behind it is what sets it apart. Many incidents or cases are not unique. They’ll have happened before. There will already be a precedent or a ruling that you can research to give you the information you require. But sometimes, to really strike a blow, you need to come up with a unique angle, a special argument or even a highly specific creative analogy. Understanding this is part of the skill of the lawyer, the researcher or the consultant. The more you use creativity, the more comfortable you become with it and the more powerful it becomes. One area that we all need to use a lot of creativity in is in the drafting of demand letters. As we talked about here, a demand letter is often the first step in resolving a dispute. It’s the chance to set out the issues clearly in writing. It’s your opportunity to propose a resolution and lay out your threats if the matter is not settled. But it’s important that your demand letter is well-written. It should be clear, concise and thought through. It should deal with all relevant issues and be relevant to the contract in question. You should set out your demands carefully and in a way that’s compelling and accurate. But written correctly, a demand letter can start the settlement process or open up a productive dialogue between parties.
